Don’t Throw That Vape in the Garbage!

New Cannabis Vape Recycling Regulations in California

Did You Know?

As of July 1st, 2024, a significant change has come to the cannabis industry in California: it is now formally illegal to throw cannabis vapes in the regular garbage. (Not in the Green Bins!) This new regulation mandates that cannabis clubs establish recycling programs or make considerable progress towards implementing them. With the rising popularity of cannabis vapes, this legislation marks an essential step toward sustainable cannabis consumption and effective waste management.

Overview of the New Legislation

The new law, effective from July 1st, 2024, prohibits the disposal of cannabis vapes in regular trash. Cannabis clubs are now required to implement recycling programs to manage this e-waste. The intent behind this legislation is clear: to protect the environment, reduce e-waste, and promote sustainable practices within the cannabis industry (California Legislative Information, 2024; Marijuana Moment Article, 2024).

“Disposables” Re-Defined? Yes, Kind Of

This new legislative change makes a definitional change to the word “disposables”. Not to worry! BTE has it all covered here for you.

The new legislation fundamentally changes the concept of “disposable” in the context of cannabis vapes. The term “disposable” can no longer imply that cannabis vapes can be casually thrown away. Instead, it must signify that these products are meant to be used until they are empty and then responsibly recycled.

Let’s cut to the chase: now, both manufacturers and consumers are more liable and responsible for ensuring safe disposal.

Changes To Expect @the Club

Manufacturers may need to redesign their products to facilitate easier recycling. This could involve using more recyclable materials or designing vapes in a way that makes them easier to disassemble for recycling purposes (Headset, 2023). Educating consumers on the proper disposal of these “disposable” vapes becomes crucial. This is where the Budtender and Ambassador come into play, which we’ll cover below.

Marketing materials and product labels will need to reflect the new reality. The term “disposable” should be accompanied by clear instructions on how to recycle the vapes and information about the environmental impact of improper disposal (California Legislative Information, 2024). Proper recycling of “disposable” cannabis vapes will significantly reduce their environmental footprint. This shift helps mitigate the e-waste problem and aligns with broader environmental sustainability goals (PubMed, 2023).

Companies must ensure their products comply with the new regulations. This includes setting up recycling programs and possibly working with third-party recycling services to manage the collection and processing of used vapes (Weedmaps, 2024). While there may be initial costs associated with setting up recycling programs and redesigning products, these costs could be offset by the positive environmental impact and potential consumer goodwill generated by sustainable practices as well as long term ROI via sustainability-based incentives and future innovations (Google Scholar, 2023).

A built in long term sustainability campaign would spur job growth in new areas across the Cannabis sector and larger economy

What’s Uncle Sam’s Problem Now?

In a word: heavy metals. Well, thats technically two words, but the point remains! Vape cartridges and pods are made using lithium-ion batteries. Lithium is a heavy metal and is rare, meaning it takes a lot to get it from the ground to your device. Moreover, much of the trash we toss out ends up in the ocean or in water, via some form or another from lakes to rivers and the ocean. Lithium reacts extremely violently with water, and this could cause caustic and toxic water issues with which we cannot afford to deal and we cannot afford to leave our children.

Implications for Cannabis Clubs

Operational Changes

Cannabis clubs must establish recycling programs, which may involve collaboration with specialized recycling facilities. While this presents potential costs and logistical challenges, it is a necessary step for compliance and environmental stewardship (Headset, 2023). It is our position that the earliest voluntary adopters of these programs and initiatives will become those who make policy moving forward.

Compliance Requirements

In order to be compliant, Clubs must document and report their recycling efforts. This includes educating and training staff and members on proper disposal methods to ensure everyone understands the new procedures (Leafly, 2024).

Potential Penalties

Non-compliance with the new regulations can result in fines, and clubs may be subject to inspections to enforce the law (California Legislative Information, 2024).

For Consumers

Responsibilities

The Cannacommunity is one that should recognize our collective responsibilities. When it comes to practical matters like disposal, consumers must now ensure they dispose of their vapes properly by moving toward and participating in codified recycling programs. Awareness of new drop-off points or methods for recycling is crucial (Leafly, 2024).

Benefits to Consumers

By participating in these programs, consumers contribute to environmental sustainability. Some cannabis clubs might offer incentives or discounts to encourage participation (Weedmaps, 2024). These accolades can be supplemented with membership rewards, access to exclusivity, and/or other recognition.

Educating Consumers

BTE will assist CA cannabis clubs with guidance on developing and launching informational campaigns and provide workshops and materials on recycling practices to educate consumers about the importance of proper disposal (PubMed, 2023).

Training Budtenders & Brand Ambassadors

Role of BTs & BAs

Budtenders & Brand Ambassadors play a crucial role in educating patients and customers about the new regulations and proper disposal methods. They are ambassadors of sustainability within the cannabis community (Budtenders Ethos, 2024). This engagement is crucial for both dispensaries and brands because today’s leaders in these areas of interest will become tomorrows authorities. We all know our industry won’t soon be receiving any help from the Hill, so it must be a grassroots effort, which BTE supports fully.

Training Programs

Clubs will develop comprehensive training programs to ensure budtenders are well-informed about the legislation and its implications. Training will include techniques for effectively communicating with customers about the importance of recycling (Budtenders Ethos, 2024).

Customer Education

Educating customers from the start is vital. Budtenders will provide clear instructions and resources on how to dispose of vapes properly, emphasizing the environmental impact of improper disposal (Budtenders Ethos, 2024). To accomplish this task will require systematic new training regimes for budtenders and brand ambassadors in the vape segment.

Environmental and Social Benefits

Reduction of E-Waste

Proper recycling of vapes helps mitigate the harmful effects of e-waste on landfills and ecosystems, preserving natural resources (JSTOR, 2023).

Corporate Social Responsibility

Cannabis clubs adhering to these regulations will enhance their reputation, showcasing their commitment to environmental responsibility and positively impacting their community (Google Scholar, 2023).

Long-Term

This legislation encourages sustainable practices across the industry and paves the way for broader recycling initiatives beyond cannabis vapes (Google Scholar, 2023). Budtenders Ethos believes in environmental stewardship and strongly encourages everyone to recycle their vape carts at their nearest collection location. As time moves forward, our embedded eco-conscious approach will yield a naturally self-governing system that minimizes its footprint when possible & practical.

Challenges and Solutions

Common Challenges

Establishing recycling programs involves initial setup costs and logistical challenges. Ensuring consumer compliance can also be a hurdle (Headset, 2023).

Proposed Solutions

Beyond the criticality of clarity and education, financial incentives for both clubs and consumers, partnerships with recycling companies & waste management incentives, and government grants can all help overcome the challenges we face, in the process helping keep the planet a little bit cleaner, while enriching and supporting our fledgling but wise community.(Leafly, 2024).

So What Can Be Said?

The new legislation on cannabis vape recycling is a significant step towards a more sustainable and environmentally conscious cannabis industry. Consumers and cannabis clubs alike must participate actively in these recycling efforts to ensure compliance and maximize the environmental benefits. Budtenders play a critical role in this transition, serving as educators and promoters of sustainability within the community. Keeping customers informed on their responsibilities as the law evolves is going to be key koving forward.

What Can We Do?

We encourage everyone to spread awareness about these new regulations and to participate actively in recycling programs. Together, we can make a collective effort toward a greener and more sustainable cannabis industry.
